The indenture is the formal conveyance document that transfers ownership of land from one party to another in Ghana. Understanding this process is essential for any property buyer.

What is an Indenture?

An indenture is a legal document that records the transfer of land ownership. It contains the names of the parties, a description of the land, the purchase price, and the terms and conditions of the transfer.

Key Components

  • Parties involved (grantor and grantee)
  • Property description with plot number and site plan
  • Purchase consideration (price paid)
  • Covenants and conditions
  • Signatures of both parties and witnesses

The Stamping Process

After signing, the indenture must be submitted to the Ghana Revenue Authority for stamp duty assessment. The stamp duty is a percentage of the property value.

Registration at Lands Commission

Once stamped, the indenture must be registered at the Lands Commission. This is the most critical step — registration gives public notice of ownership and protects against double sales.

Title Certificate

After registration, a title certificate is issued. This is the ultimate proof of ownership in Ghana.
